Rubbish Removal Shoreditch Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Shoreditch provides rubbish removal and waste collection services. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting rubbish removal or waste collection services.
Company means Rubbish Removal Shoreditch, the provider of the services.
Services means any rubbish removal, waste clearance, waste collection, loading, transportation, and related services supplied by the Company to the Customer.
Waste means any items, materials, junk, rubbish, or refuse that the Customer asks the Company to remove, excluding any prohibited or hazardous materials as set out in these Terms and Conditions.
2. Scope of Services
The Company provides rubbish removal, waste collection and associated clearance services for domestic, commercial and other premises. Services may include collection of bagged waste, bulky items, furniture, appliances, garden waste, builders waste and general household or office rubbish, subject to these Terms and Conditions.
The exact scope of the Services will be agreed with the Customer at the time of booking or upon arrival at the premises, based on the description of the waste, volume, access conditions and any other relevant factors.
3. Booking Process
3.1 Bookings may be made by telephone, email or through an online enquiry or booking form where available. All bookings are subject to acceptance by the Company.
3.2 When making a booking, the Customer must provide accurate information, including:
(a) full address where the waste is located;
(b) contact details for access on the day of collection;
(c) description and approximate volume or weight of the waste to be collected;
(d) any access restrictions, parking limitations or special requirements.
3.3 Any quote provided before arrival at the premises is based on the information supplied by the Customer. If, upon arrival, the waste differs in type or volume, or if access conditions are different from those described, the Company may adjust the price accordingly or refuse to carry out part or all of the Services.
3.4 A booking is not confirmed until the Customer has accepted the quoted price and the Company has issued a booking confirmation verbally, by email or by message. The Company reserves the right to refuse any booking at its sole discretion.
4. Service Charges and Pricing
4.1 Prices are generally based on the volume of waste, type of material, weight limits, labour time required, and any additional costs such as parking charges or congestion charges where applicable.
4.2 The Company will provide an estimate prior to the service based on the Customer's description. A final price will be confirmed on site once the waste has been inspected. If the Customer does not agree to the revised price, the Company may cancel the service and the Customer may be liable for a call-out charge to cover travel and administration costs.
4.3 All prices are quoted in pounds sterling and may be subject to applicable taxes or charges. The Customer will be informed of any such charges before confirming the booking.
5. Payments
5.1 Payment is due on completion of the Services, unless otherwise agreed in writing in advance. For certain bookings, the Company may require a deposit or full prepayment to secure the appointment.
5.2 The Company accepts payment by cash, bank transfer, or accepted debit and credit cards. The specific payment methods available may be confirmed at the time of booking.
5.3 Where the Customer is a business or organisation operating on account terms agreed with the Company, invoices are payable within the period specified on the invoice. If no period is specified, payment shall be due within 14 days of the invoice date.
5.4 If the Customer fails to pay any sum due, the Company reserves the right to charge interest on the overdue amount at the statutory rate, together with any reasonable costs incurred in recovering the debt.
6. Cancellations and Amendments
6.1 The Customer may cancel or amend a booking by giving notice to the Company by telephone or email.
6.2 If the Customer cancels more than 24 hours before the scheduled service time, no cancellation fee will normally apply, unless a non-refundable deposit has been taken and advised as such at the time of booking.
6.3 If the Customer cancels less than 24 hours before the agreed arrival time, the Company reserves the right to charge a cancellation fee to cover lost time, travel and administration costs.
6.4 If the Customer is not present at the property at the agreed time or fails to provide access, the Company may treat the booking as cancelled and may charge a call-out or cancellation fee.
6.5 The Company may cancel or reschedule a booking at any time due to operational reasons, including vehicle breakdown, staff availability, severe weather, safety concerns or other events beyond the reasonable control of the Company. In such cases, the Company will use reasonable efforts to notify the Customer as soon as practicable and to rearrange the Service for a mutually convenient time. The Company will not be liable for any loss arising from such cancellation or rescheduling.
7. Customer Obligations
7.1 The Customer must ensure that:
(a) the waste to be collected is clearly identified and accessible;
(b) adequate access is available for the Company’s staff and vehicle, including safe parking where possible;
(c) any necessary permissions for access, loading, or parking are obtained in advance;
(d) the waste does not include any prohibited or hazardous items as set out in these Terms and Conditions.
7.2 The Customer is responsible for any parking permits or authorisations required. Any parking penalties or enforcement charges arising from inadequate permissions may be charged to the Customer.
7.3 The Customer warrants that they either own the waste being removed or have the authority of the owner to arrange for its removal and disposal.
8. Prohibited and Hazardous Waste
8.1 The Company operates in compliance with relevant waste regulations and may not be able to remove certain types of waste. Prohibited or restricted items may include, but are not limited to:
(a) asbestos and materials containing asbestos;
(b) clinical or medical waste, including sharps;
(c) chemical or liquid waste, including solvents, oils, paints, and fuels;
(d) pressurised containers or gas bottles;
(e) hazardous electrical items not accepted at standard facilities;
(f) any other materials classified as hazardous under applicable law.
8.2 The Customer must inform the Company in advance if any hazardous or unusual materials may be present. If prohibited waste is discovered on site, the Company may refuse to remove it and may charge for any time spent or additional costs incurred.
8.3 If the Customer incorrectly describes hazardous waste as non-hazardous or fails to disclose the nature of the waste, the Customer will be responsible for any costs, fines, or liabilities incurred by the Company as a result.
9. Waste Handling and Disposal
9.1 The Company will handle, transport and dispose of waste in accordance with applicable UK laws and regulations. This includes duty of care requirements for waste transfer and use of licensed disposal or recycling facilities where required.
9.2 Once the waste has been collected and loaded onto the Company’s vehicle, it becomes the property and responsibility of the Company. Prior to loading, the waste remains the responsibility of the Customer.
9.3 The Company seeks to maximise reuse and recycling where reasonably practicable. However, no guarantee is given that any specific percentage of the waste will be recycled.
10. Liability and Limitation
10.1 The Company will exercise reasonable skill and care in providing the Services. However, the Company’s total liability to the Customer for any loss, damage or claim arising out of or in connection with the Services shall be limited to the amount paid by the Customer for the specific service giving rise to the claim.
10.2 The Company will not be liable for any indirect, special or consequential loss, including loss of profit, loss of business, loss of use, or loss of opportunity, arising out of the provision or non-provision of the Services.
10.3 The Customer must notify the Company in writing of any claim for loss or damage within 48 hours of the service being carried out. Failure to do so may affect the Company’s ability to investigate and may reduce or extinguish any potential liability.
10.4 The Company will not be liable for any damage to items or property that arises from pre-existing weakness, structural defect, poor installation, or inherent vulnerability, including but not limited to old furniture, fragile fittings, or poorly secured fixtures.
10.5 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
11. Access, Property and Parking
11.1 The Customer must ensure that the Company’s staff have safe and reasonable access to the waste. This includes clear passageways, unlocked gates, and removal of obstacles, where possible.
11.2 Where parking restrictions apply, the Customer should provide suitable arrangements or permits where possible. Any parking fees, fines, or penalties incurred due to insufficient or incorrect information may be charged back to the Customer.
11.3 The Company reserves the right to refuse to carry out the Services if access conditions create a health and safety risk to staff, property or the public. In such circumstances, a call-out charge may be applied.
12. Delays and Events Beyond Control
12.1 The Company will make reasonable efforts to arrive at the agreed time but time slots are approximate and not guaranteed. Delays may occur due to traffic, previous jobs overrunning, weather conditions or other factors beyond the Company’s control.
12.2 The Company shall not be liable for any delay or failure to perform its obligations where such delay or failure is due to events beyond its reasonable control, including but not limited to acts of God, strikes, accidents, road closures, or equipment failure.
13. Complaints
13.1 If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue.
13.2 The Company will investigate complaints in a fair and timely manner and may request additional information or evidence to assist the investigation.
13.3 Where a complaint is upheld, the Company may offer an appropriate remedy, which could include a partial refund, re-performance of the Services, or another form of resolution at the Company’s discretion.
14. Data Protection and Privacy
14.1 The Company will collect and use personal information from the Customer for the purposes of managing bookings, delivering Services, processing payments and handling communication or complaints.
14.2 The Company will take reasonable steps to keep personal information secure and will not sell or disclose it to third parties except where necessary to provide the Services, comply with legal obligations, or with the Customer’s consent.
15. Variation of Terms
15.1 The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will apply to new bookings from the date on which the revised Terms and Conditions are published or otherwise made available.
15.2 For ongoing or account customers, the Company may notify the Customer of changes, and continued use of the Services after notification shall constitute acceptance of the updated Terms and Conditions.
16. Severability
16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, such provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
17. Governing Law and Jurisdiction
17.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services provided shall be governed by and construed in accordance with the laws of England and Wales.
17.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.
